Abstract


Right to Freedom of speech and expression is a fundamental right in India expressed explicitly under Article 19. The goal of this right is to form an opinion and express it without fear and pressure, and to raise a voice against the arbitrary use of powers by the state. Dissent is important in a democracy and provides an important role to everyone in the country to take part in the democratic process. Whilst, all these embodiments of constitution, the law of sedition fails to recognise these principles. It is arbitrary and unconstitutional, and is against the interest of general public. It creates fear and thwarts the idea of free speech and having an opinion. In the cover of security and state interest, sedition has become a weapon for politicians to curb dissent.
